On January 24, 2018, a group of 15 Kentucky Medicaid beneficiaries filed a complaint in D.C. District Court challenging HHS approval of Governor Bevin’s proposal to implement work requirements in Kentucky’s Medicaid program. The approval comes in the midst of new guidance issued by CMS affirming its support for these types of initiatives. The lawsuit will likely be one of many as additional states move to implement similar proposals through the 1115 waiver process.
