President Trump Signs Executive Order on the Affordable Care Act

On Inauguration Day, President Trump signed an Executive Order instructing his administration to “exercise all authority and discretion available . . . to waive, defer, grant exemptions from, or delay the implementation of” the Affordable Care Act (ACA) pending repeal by Congress. The Executive Order is not self-implementing and does not itself impact ACA implementation.  Yet given the significant discretion granted by the ACA to administrative agencies, the Executive Order could have far-reaching implications, including with respect to ACA’s individual mandate.
